Criminal penalties can be applied for domestic violence if an individual is charged and found guilty.

Apprehended Domestic Violence Orders (AVDO) are one option available victims of domestic violence. This is a court order preventing contact that may be intimidating or violent. They operate when there is an existing domestic relationship. They can also restrict contact that prevents the defendant from possessing firearms, living in the family home, having contact with the protected person, staying specific distances away from the family home and/or protected person and not being able to try and track or locate the protected person.

Apprehended Personal Violence Orders (APVO) are issued often when there is no domestic relationship between the parties. They are to protect against victims from physical, psychological, harassment, intimidation and abuse.

Pleas

In New South Wales if you have been charged with a criminal offence and wish to plead guilty you may be entitled to a sentencing discount. This means that the sentence you receive may be more lenient than the sentence you may have received if you had been found guilty after a trial.  This area of the law can be quite complex, and there are various sentencing calculations applied depending on when you choose to enter your plea, for example prior to committal or after committal for trial. There can also be variations.

To fully understand plea submissions and sentencing negotiations it is advisable to contact a member of our experienced team to discuss the particular

nature of your charges for tailored advice.
